End User License Agreement

This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "you") and NoshNotes ("we," "our," or "us") governing your use of the NoshNotes mobile application (the "App") and related services (collectively, the "Service").

By downloading, installing, or using the App, you agree to be bound by this Agreement. If you do not agree to these terms, do not use the App.

1. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on Apple devices that you own or control, subject to the terms of this Agreement and the Apple App Store Terms of Service.

2. Restrictions

You agree not to:

  • Copy, modify, distribute, sell, or lease any part of the App
  • Reverse engineer, decompile, or disassemble the App
  • Use the App for any unlawful purpose or in violation of any applicable laws or regulations
  • Attempt to gain unauthorized access to the Service or its related systems
  • Use automated means (bots, scrapers, etc.) to access the Service or extract data
  • Interfere with or disrupt the integrity or performance of the Service
  • Submit deliberately false, misleading, or malicious content to the AI service

3. Subscription Terms

Free Trial

New users receive a 3-day free trial of the full Service. During the trial period, you have access to all features including AI-powered nutrition analysis and goal tracking.

Subscription

After the trial period, continued access to premium features requires an active subscription. Subscriptions are billed through your Apple ID account and managed through the Apple App Store. Subscription details, including pricing and billing intervals, are displayed before purchase.

Auto-Renewal

Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. You can manage or cancel your subscription in your Apple ID account settings. No refunds are provided for partial subscription periods.

4. AI-Generated Content Disclaimer

The nutrition information provided by NoshNotes is generated by artificial intelligence and is intended for informational purposes only. It is not medical or dietary advice.

  • AI-generated nutrition estimates are approximations and may not be accurate for all foods, preparation methods, or portion sizes
  • The Service should not be used as a substitute for professional medical advice, diagnosis, or treatment
  • Always consult a qualified healthcare provider or registered dietitian for personalized nutrition guidance
  • We do not guarantee the accuracy, completeness, or reliability of any AI-generated nutrition data
  • You are responsible for verifying nutrition information, especially if you have food allergies, dietary restrictions, or medical conditions

5. Intellectual Property

The App, including its design, code, features, and content (excluding your user data), is owned by NoshNotes and protected by intellectual property laws. This Agreement does not grant you any rights to our trademarks, logos, or branding.

You retain ownership of the food log data you enter into the App. By using the Service, you grant us a limited license to process your food entries through our AI providers solely for the purpose of providing the nutrition analysis service to you.

6. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. You may stop using the Service at any time. Upon termination:

  • Your license to use the App is immediately revoked
  • You may request export or deletion of your data by contacting us before or within 30 days of termination
  • Provisions that by their nature should survive termination will remain in effect (including disclaimers, liability limits, and dispute resolution)

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We do not warrant the accuracy or reliability of any AI-generated nutrition information.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NOSHNOTES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use of or inability to use the Service
  • Any AI-generated nutrition information or content
  • Any dietary or health decisions made based on information provided by the Service
  • Unauthorized access to or alteration of your data
  • Any third-party conduct on the Service

9. Apple-Specific Terms

This Agreement includes the following acknowledgments regarding Apple:

  • This Agreement is between you and NoshNotes only, not with Apple. NoshNotes is solely responsible for the App and its content
  • Apple has no obligation to provide any maintenance or support services for the App
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any). Apple has no other warranty obligation with respect to the App
  • Apple is not responsible for addressing any claims relating to the App or your use of it
  • Apple is a third-party beneficiary of this Agreement and may enforce it against you

10. Changes to This Agreement

We reserve the right to modify this Agreement at any time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Continued use of the Service after changes constitutes acceptance of the modified terms.
